Terms of Use & Service Agreement

Welcome to Modern Resume (accessible via www.modernresume.co and www.app.modernresume.co). These Terms of Use ("Terms") govern your access to and use of our website, applications, and services. Please read them carefully before using our services or making a purchase.

By accessing or using Modern Resume, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

(Disclaimer: Modern Resume is a product owned by Adam Bensari. References to "Modern Resume", "us", "we", or "our" refer to the service provided by the owner mentioned in the Contact section.)

1. Content Ownership

All materials found on Modern Resume — including text, videos, software code, and data — are protected by intellectual property rights and remain the property of Modern Resume, unless otherwise stated. Certain images are used under license from third-party owners and are subject to the terms of their respective licenses.

You may not copy, frame, or use any elements from Modern Resume, such as its logos, designs, layouts, or software, without written permission. Reverse engineering, inserting harmful code, or mining data from Modern Resume is strictly forbidden. Unauthorized scraping or data extraction is also not allowed.

2. Acceptable Use Policy

You agree to use Modern Resume only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the service. Specifically, you agree not to:

• Use the service for illegal, fraudulent, or harmful activities.
• Distribute malware, viruses, spyware, or any harmful software.
• Conduct automated data collection (scraping) without permission.
• Sell, resell, or transfer templates or accounts to third parties.
• Use the platform for spamming or unsolicited marketing.

You must be at least 18 years old to use Modern Resume services regarding payments.

3. Technical Requirements

To use Modern Resume properly, the User needs:

• A device with Internet access (computer, tablet, or smartphone).
• An up-to-date web browser (e.g., Chrome, Firefox, Safari, Edge) with JavaScript and Cookies enabled.
• An active email address.
• Software capable of opening PDF files (to view generated resumes).

4. Security Measures

We implement strong security measures (including SSL encryption) to protect your data from unauthorized access. However, no internet-based system is completely immune, and we cannot guarantee total security at all times. You are responsible for keeping your login credentials confidential.

5. Links to Third Parties

Modern Resume may link to third-party websites or services. We do not control these external sites and are not responsible for their content or privacy practices. Use them at your own risk.

6. Warranty and Services Disclaimer

Modern Resume aims to provide top-quality services, but they are offered “as is” and “as available.” We do not warrant that the service will run 24/7 without interruption or that it will be error-free. We may update and improve features based on user feedback.

7. Governing Law

These terms are governed by the laws of Poland and the European Union. Any disputes related to these Terms will be subject to the jurisdiction of the courts competent for the owner's seat (Wrocław, Poland), unless consumer protection laws require otherwise.

8. Changes to Terms

Modern Resume may update these terms from time to time. Significant changes will be communicated through prominent notices or emails. Continued use of the service after changes constitutes acceptance of the new Terms.

9. Account Termination

We may immediately suspend or terminate accounts that violate our terms. Provisions regarding ownership, warranties, and limitations of liability continue even after termination.

10. Payments and Refund Policy

Modern Resume offers the following payment options for accessing our services:

• Lifetime Access: $9 for unlimited access to the application and unlimited downloads, with no recurring fees.
• Single Download: $3 for one downloadable file.
• 10-Download Pack: $6 for a pack of 10 downloadable files.

All prices are final and include applicable taxes (e.g., VAT). Payments are processed securely by Stripe.

No Refunds / Right of Withdrawal Exception:
By purchasing any of our digital services, you expressly request the immediate performance of the contract (immediate access to the digital content) and you acknowledge that you lose your 14-day right of withdrawal under EU consumer law once the access is granted or the file is downloaded.

Refunds are not available once you have used the service (logged in, accessed features, or downloaded a file). If you experience a technical error caused by our platform preventing you from using the service, please contact support for resolution.

11. Complaints Procedure

If you encounter any issues with the service, you have the right to file a complaint.

• Complaints should be sent via email to: moderncv.us@gmail.com.
• Please include your email address used for the purchase, a description of the problem, and the date of occurrence.
• We will review and respond to your complaint within 14 days of its receipt.

12. ODR Platform (EU Consumers)

In accordance with EU Regulation No 524/2013, we inform you about the possibility of using the Online Dispute Resolution (ODR) platform for resolving disputes between consumers and entrepreneurs at the EU level. The platform is available here: http://ec.europa.eu/consumers/odr.
